Luke had suffered a fractured skull and a severe brain injury, while in the care of his foster mother. Luke was originally placed in foster care, due to alleged drug use by his parents, although they had been clean for several months. Luke was put in foster care on July 22 2008 after being removed from parents on July 5 2008.
It is believed, Luke had been jumping on his bed when he fell and struck his head on the floor. His foster mother found him unresponsive on his bedroom, Luke was rushed to hospital but he was already dead. Luke's foster mother (who was 74 years old) was sleeping off fatigue, due to a change in medicine when the accident occurred. She had left 2 year old Luke unattended for over two hours. Luke's foster mother has been cleared of any wrongdoing. There was no signs of abuse and Luke's death was declared as a tragic accident.
