On July 12 2008, Maxx was taking into his bedroom for a nap by his father, Justin Albury. A around 30 minutes later, Maxx's mother, Niki, went to look for them as Justin hadn't come out yet. She went into the bedroom and found Justin asleep on the bed with Maxx on his chest.

When Niki tried to wake Maxx, we wouldn't and she began worrying and screaming. She picked Maxx up and put him on the floor where she began CPR. Justin rang 911 and Maxx's older brother, Joel, went and got the neighbour who was a ambulance officer. He took over CPR but Maxx wasn't responding. Maxx was rushed to hospital.

Justin and Niki was then told that  Maxx had passed away. Maxx had passed away from SIDS. Sudden infant death syndrome (SIDS) sometimes known as "cot death" is the sudden, unexpected and unexplained death of an apparently healthy baby. SIDS usually occurs when a baby is asleep, although it can occasionally happen while they're awake.
